Please read these Terms of Use ("Terms", "Agreement") carefully before downloading, installing, or using the Gymbino mobile application ("App", "Gymbino", "Gymbino Pro").
By downloading, installing, or otherwise accessing the App, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree with these Terms, you must not download or use the App.
These Terms constitute a legally binding agreement between you ("User", "you", "your") and Taylor Simmons ("Developer", "we", "us", "our"), the developer of the Gymbino application.
By accessing or using Gymbino you represent that:
If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Gymbino is a personal workout and fitness tracking application for iOS devices. Features may include but are not limited to:
Gymbino is intended solely as a personal fitness logging and informational tool.
Gymbino provides information for informational and entertainment purposes only. Nothing in the App constitutes medical advice, diagnosis, or treatment. The App is not a substitute for professional medical advice from a qualified healthcare provider.
You should consult a physician or qualified healthcare professional before starting any exercise program, especially if you:
Exercise involves inherent risks including injury, illness, and in rare cases death. By using Gymbino, you voluntarily assume all risks associated with physical exercise.
Metrics such as calories burned or estimated one-rep max are mathematical estimates and may not reflect actual physiological values. They should not be relied upon for medical or nutritional decisions.
Workout recommendations generated by the App are general suggestions based on user inputs and general fitness principles. They are not personalized advice from certified trainers or medical professionals.
If you experience symptoms such as chest pain, dizziness, or unusual discomfort during exercise, stop immediately and seek medical attention.
To the fullest extent permitted by law, the Developer shall not be liable for injuries or damages arising from use of the App.
Gymbino does not require user accounts. Data is stored locally on the device using Apple's on-device storage technologies and optionally synced through Apple iCloud / CloudKit.
If enabled, data may be synchronized through Apple's iCloud service under your Apple ID. This data is governed by Apple's iCloud Terms and Privacy Policy. The Developer does not have access to your iCloud data.
All workout data you create in Gymbino belongs to you. The Developer does not collect, store, sell, or access your personal fitness data.
The Developer is not responsible for data loss resulting from: device failure, software issues, iCloud synchronization problems, or accidental deletion.
The App may include a feature allowing you to permanently delete all stored data. This action is irreversible.
Users may export custom workout templates and share them via iOS sharing features. You are solely responsible for content shared with others.
Gymbino may offer optional premium features through a subscription called Gymbino Pro. These may include:
Subscriptions are billed through your Apple ID account via the Apple App Store. Subscriptions automatically renew unless canceled at least 24 hours before the renewal date.
You can cancel subscriptions through Apple ID Settings → Subscriptions. Access to premium features continues until the end of the billing period.
All purchases are handled by Apple. Refund requests must be made through Apple Support.
Users may restore previous subscriptions using the Restore Purchases feature.
The App is licensed, not sold, to you. Use of the App is also governed by Apple's Standard End User License

Apple is not responsible for the App or its content.
You are granted a limited, non-exclusive, non-transferable license to use Gymbino on Apple-branded devices that you own or control. You may not:
Gymbino and all associated content including name and branding, user interface design, software code, graphics and illustrations, and workout suggestion algorithms are owned by Taylor Simmons and protected by intellectual property laws.

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the App will be uninterrupted, error-free, or completely accurate.
To the maximum extent permitted by law, the Developer shall not be liable for indirect or consequential damages, loss of data, lost profits, or physical injuries related to exercise.
Total liability shall not exceed the amount paid for the App in the previous 12 months or $10, whichever is greater.
You agree to indemnify and hold harmless the Developer from claims resulting from: misuse of the App, violation of these Terms, or injuries resulting from exercise activity.
These Terms are governed by the laws of the State of Georgia, United States. Any disputes shall be resolved in the courts located within Georgia.
We may modify the App or these Terms at any time. Continued use of the App after updates constitutes acceptance of the revised Terms.
You may terminate this agreement by deleting the App. We may suspend access if the Terms are violated.
Gymbino may use Apple services including iCloud / CloudKit, StoreKit, and iOS system frameworks. Use of these services is governed by Apple's terms.
As of the effective date of these Terms, Gymbino does not integrate with Apple HealthKit. If integration is added in the future, these Terms will be updated.
You agree to comply with United States export laws when using the App.
These Terms constitute the entire agreement between you and the Developer.
If any provision is found unenforceable, the remaining provisions remain valid.
